Shaughnessy v. United States ex rel. Mezei

Consider how the Mezei case is different from Knauff. Why is it worse, from a justice perspective? Read Justice Jackson's dissent closely. Does he accept Mezei's substantive due process challenge as well as the procedural due process argument? What is the difference between the two?

As with Knauff, Mezei was eventually granted a hearing. Unlike Knauff, there was an alternate ground for his exclusion - a prior conviction for petty larceny, which counts as a crime of moral turpitude. Also in the background was Mezei's association with Communist organizations. Mezei was found excludable and his permanent residence status was denied. He was, however, paroled into the United States, living in Buffalo until his death a decade later.
