The following case is one of the most mischaracterized corporate cases we will read. At issue is whether a for-profit corporation is entitled to a religious exemption from a rule requiring it to provide contraceptives that it consider abortfacients.

As you read, consider:

  • What personality theory is used by the majority and which is used by the dissent? Does either side argue that corporations are people?
  • Do either the majority or dissent argue that corporations must maximize profits?
  • Do these positions surprise you?
