This section of the Code of Federal Regulations has the force of law, though the statute controls. The regulations, most of them found in Title 8, supply useful elaborations on the statutory text. See here for instance section 216.4(a)(5), which sets out the kind of evidence that can be submitted by way of demonstrating that the marriage was not entered into for purposes of evading the immigration law.
