AAUP v. Rubio (D. Mass. 2025)
This district court decision considered the use of 212(a)(3)(C), 237(a)(4)(C), and 221(i) to deny admission to, order the deportation to, and revoke the visas of various non-citizens for reasons relating to their participation in pro-Palestine speech activities. It will almost surely be overtaken by appeals court rulings, but it sets out a pretty good rationale for distinguishing Harisiades in the current context of First Amendment jurisprudence.
