Winterbottom v. Wright
The defendant, Wright, a manufacturer of mail coaches, contracted with the Postmaster-General, Atkinson, to provide and maintain mail coaches in a "fit, proper, safe, and secure state" for delivery of the mail. The defendant failed to comply with his obligations under the contract, and the plaintiff, Winterbottom, a mail coach driver, was seriously injured when the coach he was driving broke down due to improper maintenance of the coach by the defendant.
