The Queen v. Dudley and Stephens
Our first case illustrates some of the principles set forth in the introduction, and deviates from others. For example, the case does not rely upon a statute. But it does touch on the purposes of criminal law, the division of roles between different institutional players, and what counts as valid sources of law (at that time).
