Brief Statement of the Facts:
Schechter Poultry was a kosher slaughterhouse located in Brooklyn, New York. Schechter generally obtained poultry by intrastate purchases, but occasionally made out of state purchases. Schechter was charged with various offenses, including selling an "unfit" chicken, wage and hour violations, and trade practices violations. The charges arose under the "Live Poultry Code" promulgated under the National Industrial Recovery Act (NIRA), a key piece of New Deal legislation. NIRA authorized the president to create "codes of fair competition" for trades and industries.
