Notes on United States v. Gementera

"Shaming Conditions" as alternatives to incarceration

What was the judge trying to accomplish by requiring Gementera to wear a sandwich board in public? What was the source of his authority to craft such a condition? Does the statute suggest limitations on that authority? What was the standard of review that the appellate court applied to the judge's sentencing decision? Do you think the appellate court would have imposed the same or similar conditions, or can you tell from the opinion?

Based on the statutory standard, what criteria must the sentencing court's conditions satisfy to be valid? How did the sentencing judge's criteria hold up under the appellate court's scrutiny? Do you think there were other ways the court could have accomplished its objectives?

The Court refers to other cases in which courts imposed unusual conditions on a probation sentence. Can you perceive a distinction between conditions that are upheld, and those which are not?
