Gitlow v. New York
Gitlow is the case credited with recognizing that the First Amendment is "incorporated" against the states by virtue of the Fourteenth Amendment. Think about how that works textually, logically, legally.
I have included a portion of Justice Holmes' brief dissent. It has nothing to do with incorporation. In Gitlow and two other cases you'll read for the next class (Abrams and Whitney), Justice Holmes and Justice Brandeis wrote three of the most important opinions in the history of constitutional law, essentially revealing the First Amendment as we recognize it today.
