What relationships do you see between this history of discrimination and the bar admission requirements that you read about for class 2 and that we discussed in class?

To what extent is this section in the textbook consistent or inconsistent with your own experience in legal environments or in law school?

Second, read the following hypo and then answer the two questions below:

Imagine you are an attorney in New York and you are at work at your small law firm. One of your colleagues runs in and says:

I need advice quickly! I just got a frantic call from a client who said he’s driving – he’s on his way home - and now he’s in a line of cars -  Looks like he’s headed toward a checkpoint. A DUI checkpoint – a sobriety checkpoint! These are the ones where they stop each car, take a look at you and if you look like you have too much to drink they give you a breathalyzer test.

My client is freaking out! He told he “I’m not drunk, but I just came from a birthday brunch and I’ve had a couple drinks” He’s called me to find out what he should do – should he refuse to take the breathalyzer test?

And I need to know –What advice is it ethical for me to give him?

2.   Before you look at your rule book, please write down how you think you might answer your colleague’s question and identify the ethical issues that might be present. (So this answer should reflect just your own judgement and common sense.)

3.  Now look through the New York Rules of Professional Conduct (link on Brightspace), and try to determine an answer to your colleague’s question using the rules. (Your answer should include the advice you would give and the rules you are relying on.)

As explained in class, please engage in two hours of research and then spend up to two hours preparing a document that describes your research results. For each ethics opinion or case, please include: (a) citation; (b) rule being addressed; (c) relevant holdings; (d) useful dicta; and (e) how you found it. For each secondary source, please include: (a) citation; (b) summary. Please do not use a secondary source to convey information about a specific opinion or case; instead cite the opinion or case directly. Please submit the document on Brightspace as Writing Reflection #4. Please note that the formatting guidelines for Writing Reflections do not apply to this assignment.
