Demand and Waiver of Trial By Jury
A plaintiff must demand a jury trial (very) early in litigation, usually in the complaint. A defendant must demand a jury trial (very) early in litigation, typically in the answer. Parties that do not demand a jury trial early and clearly waive the right.
