Rules and Constitutional Provisions
This class period begins several days on the allocation of power between a judge and a jury and on how a trial proceeds. The first doctrine is law versus equity. This distinction determines whether a jury or a judge decides disputed issues of fact. This doctrine, the distinction between law and equity, stems from the historical development of the judicial system in what is now the United Kingdom.
