Mavrix Photographs, LLC v. LiveJournal, Inc.

In this case, LiveJournal ran a gossip site (Oh, no they didn't!) (That's the name of it. Oh, no they didn't.). Users were able to upload photos, and a paparazzi company sued, arguing that LiveJournal's volunteer moderators were agents of LiveJournal, making LiveJournal liable for the infringement.
If you were the court on remand, how would you decide given the rules we have covered thus far? What policy implications might your decision have on future economic actor's decision making?
