Open View and Gaps in Curtains
A guide for Colorado law enforcement officers balancing expert legal knowledge with practical step by step guidance on 4th amendment issues and the reasonable expectation of privacy around observations made through gaps in window coverings.
On a day-to-day basis, law enforcement officers in Colorado face complex legal decisions lawyers, experts, and courts get to question and debate for years afterward. These decisions are frequently and by necessity made at a moments notice and without the benefit and guidance of a prosecutor standing beside them to make them aware of legal pitfalls. Truly, law enforcement officers have to have a stronger command of these issues than even the attorneys who get to litigate these cases with the benefit of hindsight. This guide is part one in a series that will help officers achieve that difficult goal.
